Overview
These terms and conditions ("Agreement") govern your use of CPRTestCenter.com ("Site"), an online information service operated by CPR Test Center ("CPR Test Center", "we", "our", "us", etc.). CPR Test Center knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. By visiting CPRTestCenter.com, you are accepting the practices described in this Agreement.

General Privacy Policy
We will not sell, share, trade, or give your personal information to any third party outside of CPR Test Center with the following exceptions. We may share your personal information with eCPRVerify National Registry, payment processing networks, certain other organizations described below, and when required by law or by court mandate. This may include your name, email address, phone number, street address, and other information that is generally not publicly available. We may contact you with certification reminders, renewal reminders, or in the case of billing or shipping problems. With the exception of the above, CPR Test Center will not contact you via email, postal mail, telephone or otherwise, unless it is in response to an inquiry you initiated or to ship an item that you purchased.

Shared Information
When you are certified by CPR Test Center, your information is shared with eCPRVerify National Registry and when requested by certain other organizations (e.g. staffing agencies, human resources, verification services) that may require your certification status for employment, educational credit, or other reasons. The information shared may include your name, email address, phone number, street address, certificate identification number (also known as your invoice number), certificate date, certificate status, and other information that is generally not publicly available. Employers as well as the public at large can use eCPRVerify National Registry to verify your certificate status. The purpose of the registry is to enable employers to verify CPR certification compliance of their employees. If you do not wish your information to be shared with eCPRVerify National Registry, you may opt-out by writing to us via the Contact Customer Service form.

Information Automatically Logged
As with almost all internet websites, our web server logs your IP address. Your IP address does not personally identify you unless you provide other information to us, such as when you contact us or order an item.

Personal and Financial Information
We use Authorize.net, Paypal, Square, or other payment processing networks for you to order products and/or services. Financial information is secured at the payment processing network and therefore we do not store any financial data from you. Personal information such as your name, mailing address, email address, and related information are stored to process and/or to ship orders. Personal information from you contacting us via email or the Contact Customer Service form is used to reply to your inquiries. Personal information includes your name, email address, IP address, and any other information you provide to us.

No Representation, Warranty or Guarantee
All content ("Materials") on this Site are provided "as is" and without any representation, warranty or guarantee of any kind, either express or implied. To the fullest extent permitted under applicable law, CPR Test Center disclaims the warranties of merchantability and fitness for a particular purpose. CPR Test Center does not make any representation, warranty or guarantee regarding the use of, the efficacy of or the results of the use of the Materials, including but not limited to its correctness, completeness, accuracy or reliability. CPR Test Center does not make any representation, warranty or guarantee as to the content, sequence, accuracy, timeliness or completeness of the Materials or that the Materials may be relied upon for any reason. CPR Test Center does not make any representation, warranty or guarantee that you or any ceretified individual will be able to perform CPR or First Aid or use an AED in an actual emergency.

No Reliance
You should not solely rely on the Materials, but should instead seek other opinions before taking or failing to take any action which could lead to injury, harm, death or damage of any kind. CPR, First Aid, and AED procedures should be performed only on persons who require them and generally under the supervision of a licensed professional. Do not attempt or practice CPR procedures on anyone that does not need them. Performing CPR procedures when they are not needed could result in serious injury or death. CPR procedures will not save everyone even when they are properly performed. CPR, First Aid, and AED instruction should not be viewed by children or adults who will not fully understand the Materials and their potential consequences.

No Legal Advice
CPR Test Center does not offer or purport to offer legal advice. Any legal questions should be referred to a legal professional. CPR Test Center does note the following general principles, which may or may not apply in any particular jurisdiction. A person must give consent to an offer of assistance before the rescuer renders aid. If a person is conscious, the rescuer should ask for consent before rendering help. Consent is implied if the person is unconscious, so badly hurt that the injury is potentially life-threatening or so ill that the person cannot respond. A rescuer should attempt to receive permission to render aid from a parent or guardian if the person is a minor or is mentally or emotionally handicapped. State "Good Samaritan" laws may provide rescuers with legal protection if the rescuer acts in good faith and is not guilty of gross negligence or reckless or willful misconduct. The scope of protection afforded by these laws varies from state to state; the rescuer should be familiar with the laws of any state in which he or she is rendering aid.

Indemnification
You agree to indemnify, defend and hold harmless, CPR Test Center, its subsidiaries and other affiliated companies, all persons involved in the production and operation of the Site and its contents, suppliers and any third-party information providers to the Site from and against all losses, expenses, damages and costs, including reasonable attorneys' fees.

Jurisdictional Issues
This Site is controlled and operated by CPR Test Center from its offices within the state of Nevada, United States of America. CPR Test Center makes no representation that Materials in CPR Test Center's Site are appropriate or available for use in other locations. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with their local laws, if and to the extent local laws may be applicable. This Agreement shall be governed by, construed and enforced in accordance with the laws of the state of Nevada. Any action you, any third party or CPR Test Center bring to enforce this Agreement or, in connection with, any matters related to us or to this Site shall be brought only in either the state or federal courts located in Clark County, Nevada, and you expressly consent to the jurisdiction of said courts.

Certification Disclaimer
The sole purpose of the CPR certification card, certificate, letter, or any other item you receive upon certification is to verify to the best of our knowledge that you have successfully completed our training courses and scored 70% or higher in our online test. The card, certificate, letter, or other item does not represent, warrant or guarantee that you are properly prepared or equipped to perform CPR or First Aid or use an AED. CPR Test Center's role is to provide information to you using generally accepted scientific guidelines. CPR Test Center does not represent, warrant or guarantee, either explicitly or implicitly, that its certification will comply with your or any third party's requirements or standards. It is your sole responsibility to ensure compliance with the requirements and standards of any regulatory or licensing body or employer.

Limitation of Liability
The Materials on this Site are intended for educational purposes only, to teach basic skills in accordance with general treatment guidelines. The Materials on this Site are based on various texts available to the lay public and to medical professionals. CPR Test Center has made reasonable good faith efforts to ensure the Materials' accuracy and validity. However, under no circumstances shall CPR Test Center be held liable for any losses or damages of any kind whatsoever, whether in contract or in tort or under any local, state or federal law, statute, ordinance, regulation or provision, arising out of or relating to the use of or reliance upon the Materials or this Site. To the fullest extent permitted under applicable law, you hereby hold CPR Test Center and its officers, directors, shareholders, agents, employees and representatives, and any related or affiliated persons or companies and their respective officers, directors, shareholders, agents, employees and representatives, harmless from any liability whatsoever, including but not limited to any direct, indirect, consequential or punitive damages arising out of or relating to your access to or use of this Site or the Materials, any liability for damage or injury to your or any other person's self, property or business, any claim based on any inclusion or omission in the Materials or on this Site, any claim based on CPR Test Center's procurement, compilation or delivery of the Materials on this Site, any claim based on any errors, omissions or inaccuracies in the Materials, regardless of how caused, any claim based on delays, interruptions or incompleteness in the delivery of the Materials, and any claim based on any action or inaction or decision made arising out of, relating to or relying upon the Materials or this Site. Browsing and using this Site and the Materials are done solely at your own risk.

Non-Affiliation
Our training courses follow the general treatment guidelines set forth by the International Liaison Committee On Resuscitation (ILCOR). CPR Test Center and all persons and entities involved in creating, producing and delivering this Site and the Materials are not associated with, affiliated with or endorsed by American Red Cross (ARC), American Heart Association (AHA), or any other organization.

Mandatory Arbitration, Venue, Limitation of Remedies and Damages
Any controversy, claim or dispute of any kind arising out of or relating to this Agreement, the Materials, the use of this Site or the use or the failure to properly use the Materials or this Site, or any act or omission attributable in whole or in part to the Materials or this Site shall be subject to mandatory binding arbitration pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any action or proceeding arising out of or relating to this Agreement, the Materials, the use of this Site or the use or the failure to properly use the Materials or this Site, or any act or omission attributable in whole or in part to the Materials or this Site shall be venued in the County of Clark, State of Nevada. If CPR Test Center is ever determined to be liable to you or any third party arising out of or relating to any claim against us, then your sole and exclusive remedy shall be damages payable to you or on your behalf in an amount equal to the fee you paid to CPR Test Center. If no fees were paid to CPR Test Center, then no damages will be payable to you or on your behalf.

Dissatisfaction
If you are dissatisfied with the Materials or the Site for any reason, then your sole and exclusive remedy is to discontinue accessing and using the Materials or the Site. All sales are final and no refunds will be issued.

Construction of This Agreement
The language of all parts of this Agreement shall in all cases be construed as a whole, according to its fair meaning. This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada without regard to conflicts of law principles.

Severability
If any provision of this Agreement shall be unlawful, invalid, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement, and shall not affect the validity and enforceability of any other term or provision.
